Bildnisschutz nach § 78 UrhG“

[Der Vortrag befasst sich mit dem Persönlichkeitsrecht zum Schutz des Abgebildeten in § 78 UrhG, das Rechtspraxis und Schrifttum intensiv beschäftigt. Dabei ist zwischen den berechtigten Interessen des Abgebildeten gegen missbräuchliche Bildverwendung (Recht auf Privatsphäre) und dem Interesse der Medien an der Bildberichterstattung (Presse- und Informationsfreiheit) abzuwägen. Spannung verspricht die vom OGH (6 Ob 116/17b) dem EuGH vorgelegte Frage, inwieweit der Host-Provider (facebook), der einen rechtsverletzenden Bildbegleittext nicht entfernt hat, zu proaktiven Kontrollmaßnahmen verpflichtet ist.]
